Under ACI requirements, carriers in all modes of transportation are now required to transmit cargo and conveyance data electronically to the CBSA prior to arrival at the border for risk assessment purposes. These regulations provide the CBSA with the authority to issue Administrative Monetary Penalties (AMPS) for identified non-compliance.

Since January 1, 2017 CBSA has moved to an uncapped graduated AMPS penalty system, where escalating monetary penalties can be assessed to carriers for repeated non-compliance with ACI related processes.

The purpose of this survey is to provide senior CBSA officials with a description of the penalties carriers are recieving through the AMPS penalty system and the monetary amount that members have been penalized.

CTA believes that the current system of fines, in particular for failure to submit ACI data, is out of proporation to the violation. CTA's Board is meeting at the end of March to discuss and approve a strategy to mitigate these fines.
